Terms of Service

Welcome to EshopAuditor. These Terms of Service ("Terms") govern your access to and use of the EshopAuditor platform available at eshopaudit.io ("Service"), operated by Rostyslav Honcharov, a registered sole trader (OSVČ) in the Czech Republic, IČO: 29541131 ("we", "us", or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old to use EshopAuditor. By using the Service, you confirm that you meet this requirement and that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
2. Accounts
To access most features, you need to create an account. You are responsible for:
- Providing accurate registration information and keeping it up to date.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
If you suspect unauthorized access to your account, contact us immediately at support@eshopaudit.io. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscription & Payments
Paddle as Merchant of Record
Payments for EshopAuditor Pro subscriptions are processed by Paddle.com Market Ltd ("Paddle"), which acts as the Merchant of Record for all transactions. This means Paddle handles payment processing, tax collection, invoicing, and related obligations. Your payment relationship is with Paddle, and their terms and privacy policy also apply to your purchase.
Plans and Billing
EshopAuditor offers a free tier and paid Pro plans billed monthly in EUR. Subscription prices are clearly shown before purchase and confirmed in your receipt from Paddle.
Auto-Renewal
Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You authorize Paddle to charge the payment method on file for each renewal.
Cancellation
You may cancel your subscription at any time from your account settings or by contacting support@eshopaudit.io. Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date. We do not charge cancellation fees.
Price Changes
We may change subscription prices with at least 30 days' advance notice. Price changes take effect at your next renewal after the notice period. If you disagree with a price change, you may cancel before it takes effect.
4. Acceptable Use
You agree to use EshopAuditor only for lawful purposes and in accordance with these Terms. You must not:
- Audit sites without authorization. You may only audit websites that you own, have explicit permission to audit, or are otherwise legally authorized to test. Using EshopAuditor to audit sites for malicious purposes — including unauthorized vulnerability discovery, competitive intelligence gathering without consent, or any illegal purpose — is strictly prohibited.
- Reverse engineer the Service. You may not decompile, disassemble, reverse engineer, or attempt to extract source code or trade secrets from EshopAuditor.
- Abuse the API or infrastructure. You may not use automated scripts, bots, or other means to make requests at a volume that exceeds your plan limits or that interferes with the Service for other users.
- Initiate chargebacks abusively. Filing a payment dispute or chargeback without first contacting us at support@eshopaudit.io to resolve the issue in good faith is a violation of these Terms and may result in immediate account suspension. We take chargeback fraud seriously and will provide Paddle with all relevant evidence to contest fraudulent disputes.
- Misrepresent your identity or affiliation. You may not impersonate another person or entity or misrepresent your relationship with any organization.
- Violate applicable laws. You may not use the Service in any way that violates the laws of your jurisdiction or any applicable international law.
5. Intellectual Property
EshopAuditor, including its software, design, branding, AI-generated analysis frameworks, and documentation, is owned by Rostyslav Honcharov and protected by intellectual property laws. These Terms do not grant you any ownership interest in the Service.
You are granted a limited, non-exclusive, non-transferable license to use the Service for your own business purposes in accordance with these Terms. This license is revocable and does not include the right to sublicense the Service to others.
6. User Content
Audited URLs and Results
When you submit a URL for auditing, you represent that you are authorized to do so. The HTML content of pages you audit is processed by our system — and, on Pro tier, transmitted to Anthropic's Claude API to generate AI explanations of findings. See our Privacy Policy for details.
You retain ownership of the websites you audit. Audit results generated by EshopAuditor are made available to you under your subscription and are not shared with other users.
We do not claim ownership of your websites or their content. We may use aggregated, anonymized audit data (not linked to you or your URLs) to improve and develop the Service.
7. Availability
We provide the Service on a best-effort basis. We do not guarantee any specific uptime level, and the Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Audit results and AI-generated explanations are provided for informational purposes. They do not constitute professional SEO, legal, or technical advice. You are responsible for evaluating the appropriateness of any findings for your specific situation.
9. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to the Service shall not exceed the greater of:
- The total amount you paid for the Service in the twelve (12) months preceding the claim, or
- €50.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we were advised of the possibility of such damages.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Termination
We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or if we discontinue the Service. In most cases, we will give you reasonable notice before termination, unless the violation warrants immediate action.
You may terminate your account at any time by contacting support@eshopaudit.io or through your account settings. Upon termination, your right to use the Service ceases, and we may delete your account data in accordance with our Privacy Policy.
11. International Use
EshopAuditor's interface is available in the following languages: English, Czech, Slovak, German, Spanish, French, Russian, and Ukrainian. Offering these languages does not constitute establishment or legal presence in any particular country. Users are responsible for complying with the laws of their own jurisdiction when using the Service.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
If you do not agree with the updated Terms, you may cancel your subscription and stop using the Service before the changes take effect.
13. Governing Law
These Terms are governed by the laws of the Czech Republic, without regard to its conflict-of-law principles.
EU consumer protection carve-out: If you are a consumer residing in an EU member state, nothing in these Terms limits or waives any rights you have under the mandatory consumer protection laws of your country of residence, including rights under the EU Consumer Rights Directive. In the event of a conflict between these Terms and mandatory consumer protection laws applicable in your country, those laws take precedence for B2C disputes.
Any disputes that cannot be resolved amicably may be brought before the competent courts of the Czech Republic, or, if you are an EU consumer, before the courts of your country of residence.
